High Diversion Organic Waste Processing Facilities

As outlined in Title 14 California Code of Regulations (14 CCR) section 18815.5(e), CalRecycle is required to assess whether a facility meets or exceeds the annual average mixed waste organic content recovery rate specified in the definition of a “high diversion organic waste processing facility” (HDOWPF) in 14 CCR section 18982(a)(33). Whether a facility qualifies as a HDOWPF is determined by 14 CCR Section 18984.3(b). Upon reviewing data submitted in CalRecycle’s Recycling and Disposal Reporting System (RDRS) database, CalRecycle has identified the facilities currently meeting the requirements of a HDOWPF. 

For additional information, CalRecycle has developed a new RDRS report: Report 9A: High Diversion Organic Waste Processing Facilities List (https://www2.calrecycle.ca.gov/RecyclingDisposalReporting/Reports/HighDiversionOrganicWasteProcessingFacilities). This new report can be found on the Recycling and Disposal Reporting: Reports List webpage (https://www2.calrecycle.ca.gov/RecyclingDisposalReporting/Reports).

Facilities in Table 1 of the report are designated as a HDOWPF as their annual average mixed waste organic content recovery rate has not dropped below 50% for two consecutive quarterly reporting periods and/or for three quarterly reporting periods during the last 3 years per 14 CCR section 18984.3(b).

Table 2 outlines facilities that meet or exceed the recovery rate of 50% for the most recent four-quarter period. CalRecycle will update these tables in accordance with 14 CCR section 18815.5(e)(3), which mandates calculating the annual average mixed waste organic content recovery rate based on the last four quarterly measurements, resulting in a new annual average for each quarter.

Why is a facility listed, or not listed on Table 2? See following questions and answers.

(1) What does it mean if my facility is on Table 2? A: Table 2 shows facilities that submitted organic measurement data in RDRS, that has been verified by CalRecycle, and that had an annual average mixed waste organic content recovery rate equal to or greater than 50%.

(2) Why is my facility not on Table 2? A: There is a lack of evidence that your facility met the annual average mixed waste organic content recovery rate of 50%. This could mean: (a) Incomplete data, i.e. less than 4 quarters of data submitted in RDRS for the 4-quarter range required to complete the annual average mixed waste organic content recovery rate calculations, and/or (b) CalRecycle investigated and verified that the data submitted was not collected appropriately (this could include but is not limited to issues with incorrect sampling, sorting, weighing etc.), resulting in unusable data required to calculate the annual average mixed waste organic content recovery rate. 

(3) How do I find the data CalRecycle used to calculate my facility’s organic recovery efficiency rate (if above 50%)? A: As new data becomes available, the website will be updated, and another notification will be sent out via the listserv.

Jurisdictions that have a collection system that is required to be processed by a high diversion organic waste processing facility should be discussing this now with their haulers and facilities. 

Jurisdictions should be assessing their programs. At some point each jurisdiction will be evaluated and sending material to a facility that is not meeting the performance requirements could result in a compliance issue that will need to be corrected. 

Without effective programs, the state will not meet the statewide target.
