The SB 1383 Regulations identify specific activities and technologies that constitute recovery of organic waste and others that are considered landfill disposal. Under the regulations, if a technology or activity is not specifically identified in either category, an interested party may request CalRecycle to perform an evaluation of its technology to determine if it constitutes a reduction in landfill disposal, in accordance with the Article 2 requirements (Title 14 California Code of Regulations Section 18983.2). In particular, the Department shall only deem a proposed operation to constitute a reduction in landfill disposal if the process or technology results in a permanent reduction in lifecycle greenhouse gas emissions equal to or greater than 0.3 MTCO2e per short ton of organic waste.
This item presents staff’s evaluation of an Article 2 technology determination application from H Cycle, conducted in consultation with the California Air Resources Board (CARB), as required by Title 14 California Code of Regulations Section 18983.2.
