This item presents staff’s analysis of Carpet America Recovery Effort’s Revised Differential Assessments Plan Amendment submitted to CalRecycle on March 24, 2026.

Public Resources Code (PRC) section 42968.30(e) requires the producer responsibility organization to submit a plan amendment by July 1, 2025, to conform its plan to the requirements of PRC sections 42968.32(c) and (j), 42968.60, and 42968.61. CARE submitted its Revised Differential Assessments Plan Amendment following CalRecycle’s determination that CARE’s November 8, 2024, Differential Assessments Plan Amendment, did not meet, at a minimum, the requirements of (PRC) sections 42968.30(e), 42968.32(c), 42972(a)(4)(A), 42972(c)(1), 42972(c)(2), its California Carpet Stewardship Plan 2023 to 2027, and CalRecycle’s December 23, 2024, Notice of Approval. 

CalRecycle’s director has 60 days to review and approve, conditionally approve, or disapprove CARE’s Revised Differential Assessments Plan Amendment (by May 26, 2026). CalRecycle will review the submitted plan amendment to determine whether the requirements of statute, regulations, and the stewardship plan were met.
